Unbundling of the distribution system operator

The distribution system operator which is a part of a vertically integrated company has to be independent in terms of the legal form, organisation and decision-making process from other activities which are not related to the electricity distribution.

The independence fo the distribution system operator is provided in the following manner:

• persons responsible for the management of the distribution system operator cannot participate in the management bodies of the vertically integrated company which are directly or indirectly responsible for electricity production, transmission or supply;
• by taking measures which will secure for the persons responsible for the management of the distribution system operator to act in a professional way so as to provide their independence in their work;
• the distribution system operator adopts decisions independently of the vertically integrated company in terms of means necessary for the operation, maintenance and development of the network;
• the distribution system operator adopts decisions on current operations independently, i.e. decisions on the construction or upgrade of the distribution network if these fall into the framework of the approved financial plan.

In line with the Energy Law (“Official Gazette of RS”, No. 145/14 and 95/18 –another law) (Article 132), the distribution system operator which is a part of a vertically integrated company is obliged to adopt the Compliance Programme for Provision of Non-Discriminatory Behaviour which includes measures aiming at the prevention of discriminatory behaviour, the manner of monitoring these measures and obligations of employees to achieve the goals which have been set.

The Agency approves (Serbian version) the Compliance Programme of the Distribution System Operator.

Person responsible for obseving compliance

The distribution system operator is obliged to appoint a person responsible for observing the compliance. The Agency gives approval (Serbian version) of conditions for the appointment and of the duration of the term of the person appointed for compliance observation as well as prior approval of the decision on the appointment.

Annual report on the implementation of the Compliance Programme

The person responsible for the observation of the compliance drafts the annual report on the implementation of the Compliance Programme and submits it to the Agency for approval.
